Article 1 - Glossary

  • VERSANFS : Established in Antwerp, with VAT number: BE1007249384
  • Customer : Any party entering into an agreement with VERSAN Fight Store.
  • Parties : VERSANFS and the customer together.
  • Consumer : A customer who acts as a private individual, not in the course of a business or professional activity.

Article 2 - Applicability

  • These general terms and conditions apply to every offer, every quotation, and all agreements and deliveries of products or services by VERSANFS.
  • Deviations from these general terms and conditions are only valid if they have been expressly agreed upon in writing between VERSANFS and the customer.
  • The general terms and conditions of the customer or third parties are hereby expressly rejected.

Article 3 - Prices

  • All prices are clearly stated in euros, include VAT and exclude any additional costs such as administration or shipping costs, unless otherwise agreed.
  • VERSANFS reserves the right to adjust the prices of its products and services at any time, as displayed on the website or other communication channels.
  • Price increases resulting from unforeseen cost increases of products or components, which were not known at the time of the quotation or the conclusion of the agreement, may be passed on.
  • In the event of a price increase, as described in the previous paragraph, the consumer has the right to dissolve the agreement, unless the price increase results from a statutory regulation.

Article 4 - Payment Terms

In the sale of products, the customer may never be required, in accordance with the general terms and conditions, to make a down payment exceeding 50% of the purchase amount. A down payment means that the customer is not entitled to delivery of the ordered products or services until this payment has been settled.

Customers must report inaccuracies in provided or mentioned payment details to the seller without delay.

Article 5 - Right of withdrawal

Customers have the right to cancel a product purchase within a period of at least 14 days without giving reasons. The seller may ask for the reason for cancellation but cannot oblige the customer to provide it.

The cooling-off period begins the day after receipt of the product by the customer or a third party designated by the customer, other than the carrier. This applies in the following situations:

  • For multiple products in a single order: from the day the customer or designated third party receives the last product. The seller may refuse an order containing products with different delivery times, provided this has been clearly communicated in advance.
  • In the event of delivery of a product in multiple shipments or parts: from the day the customer or designated third party receives the last part or the last shipment.
  • For contracts for the regular delivery of products: from the day the customer or designated third party receives the first product.

This policy offers customers the opportunity to reconsider their purchase and ensures clear communication between seller and customer, protecting the customer against unwanted purchasing pressure.

Article 6 - Reimbursement of shipping costs

If the customer revokes the purchase within the cooling-off period and returns the entire order in a timely manner, VERSANFS will not refund any shipping costs paid. Shipping costs will only be reimbursed if an error occurred in the order on our part.

Article 7 - Return Shipping Costs

If the customer exercises their right to withdraw from the purchase and returns the entire order on time, the costs of the return shipment shall be borne by the customer.

Article 8 - Retention of Title

All products remain the property of VERSANFS until full payment of all invoices related to the purchase, including any damages for non-performance.

Until full payment, VERSANFS reserves the right to reclaim the delivered products.

Article 9 - Terms of Delivery

Delivery is subject to availability.

Standard delivery takes place from VERSANFS , unless otherwise agreed.

Online orders are delivered to the address provided by the customer.

Article 10 - Delivery times

The stated delivery times are indicative. Delays do not entitle the customer to compensation or dissolution of the agreement, unless explicitly agreed otherwise.

The delivery time starts as soon as the customer has fully completed the order and has received a confirmation from VERSANFS .

No compensation for delayed delivery, unless otherwise agreed in writing, or for failure to deliver within 14 days after a formal notice. In such cases, the agreement may be terminated subject to the agreed conditions.

Article 11 - Receipt of the Delivery

The customer must ensure that the ordered products can be received without delay.

Article 12 - Transport costs

The costs for the transport of the products are for the account of the customer, unless otherwise agreed in writing between the customer and VERSANFS.

Article 13 - Packaging and Shipping

If the packaging of a delivered product is damaged or opened, the customer must immediately have a note made by the delivery service before accepting the product. Without this note, VERSANFS cannot be held responsible for any damage.

When the customer is responsible for transport, visible damage to products or packaging must be reported to VERSANFS in advance. Without notification, VERSANFS 's liability for any damage lapses.

Article 14 - Warranty

The warranty applies only to defects caused by errors in manufacturing, construction, or the use of materials. The warranty is not valid for:

  • Normal wear and tear.
  • Damage caused by accidents.
  • Damage caused by modifications to the product.
  • Damage caused by negligent or improper use.
  • Inability to determine the cause of the defect.

Article 15 - Exchange Policy

Items can be exchanged within 14 days of purchase, provided that:

  • The original invoice is shown.
  • The product is being returned in the original packaging and with the original price tag.
  • The product is unused.

Discounted items, perishable goods, custom-made or specifically adapted products, and face masks and groin protectors are excluded from exchange.

Article 16 - Indemnification

The customer indemnifies VERSANFS against all claims from third parties related to the delivered products and/or services.

Article 17 - Complaints procedure

Complaints about products or services must be reported to VERSANFS as soon as possible, but no later than 1 month after discovery. Consumers have up to 2 months after discovery to make a report.

Complaints regarding ongoing work cannot lead to the requirement to perform work other than that agreed upon.

Article 18 - Notice of Default

Any notice of default must be communicated to VERSANFS in writing, with care taken to ensure it arrives in a timely manner.

Article 19 - Customer Liability

In agreements with multiple customers, each customer is individually liable for fulfilling the agreements.

Article 20 - Liability VERSANFS

VERSANFS is liable solely for direct damage caused by intent or gross negligence. Indirect damage, including consequential damage, lost profits, or damage to third parties, falls outside this liability.

Liability is limited to the amount paid out by any liability insurance, or if not applicable, to the invoice amount related to the liability.

Article 21 - Terminate Agreement

Customers may cancel the agreement if VERSANFS fails to fulfill its obligations, unless this failure is too insignificant for dissolution. If VERSANFS can still fulfill the agreement, dissolution is only possible after a formal notice of default. VERSANFS may also dissolve the agreement if the customer fails to meet its obligations or if there are reasons to believe that this will occur.

Article 22 - Force Majeure

In the event of force majeure, whereby VERSANFS is unable to fulfill its obligations due to circumstances beyond its control, such as natural disasters, strikes, or government measures, VERSANFS shall be released from its obligations. If the situation lasts longer than 30 days, both VERSANFS and the customer may terminate the agreement in writing without any obligation to pay compensation.

Article 23 - Amendment of the Agreement

VERSANFS and the customer may amend the agreement if necessary for its execution, except for products purchased in physical stores.

Article 24 - Amendment of General Terms and Conditions

VERSANFS may amend the general terms and conditions. Minor changes may always be implemented, but for significant changes, VERSANFS will consult with the customer in advance as much as possible. In the event of substantial changes, the consumer has the right to terminate the agreement.

Article 25 - Transfer of Rights

Customers may not transfer their rights under the agreement to third parties without the written consent of VERSANFS, in accordance with Article 3:83 paragraph 2 of the Dutch Civil Code.

Article 26 - Nullity or Voidability

If any part of these terms and conditions proves to be void or voidable, the remaining provisions shall remain valid. Void or voidable provisions shall be replaced by provisions that are as close as possible to the original intention of VERSANFS.

Article 27 - Applicable Law and Competent Court

These general terms and conditions and all agreements between the customer and VERSANFS are governed by Belgian law. Disputes shall be exclusively submitted to the competent court in the district where VERSANFS is established, unless otherwise provided by law.
